Minutes of the Special Meeting of the Legislative Council
Held in the Board Room in the Newtown Municipal Center,
3 Primrose Street, Newtown, Connecticut

Chairman Jeffrey Capeci called the meeting to order at 7:30 pm.
PRESENT: George Ferguson, Ben Spragg, Dan Amaral, Gary Davis, Rich Woycik, Kevin Fitzgerald, Bob Merola, Kathy Fetchick, Mary Ann Jacob, and Chairman Jeff Capeci
ABSENT: Jan Andras and Jim Belden
ALSO PRESENT: First Selectman Patricia Llodra, Town Attorney David Grogins, and 2 members of the press.
VOTER PARTICIPATION: none
Chairman Capeci announced they would skip Unfinished Business: Discussion and possible action on: Charter Revision Commission Draft Report as there would be no action on it that evening; and he called for a motion to go into executive session.
Mr. Davis made a motion to go into executive session at 7:32 pm to discuss possible litigation vs. Dauti Construction, LLC and invited the First Selectman and Town Attorney to attend. Mr. Ferguson seconded and the vote was unanimous.
At this time, the Clerk left the meeting.
The Council exited executive session at 7:58PM.
Ms. Jacob moved the following resolution: “To permit the First Selectman to pursue Supreme Court appeal in litigation vs. Dauti Construction, LLC and recommend the First Selectman to seek reimbursement for litigation costs by the Newtown Water and Sewer Authority.” Motion seconded by Ms Fetchick, all in favor.

Ms. Jacob made the motion to adjourn at 8:01 pm. Mr. Fitzgerald seconded and the motion was unanimously carried.
